It is the customer’s responsibility to know the laws in his or her jurisdiction prior to purchasing products from Bear State Tactical.
No product offered for sale by Bear State Tactical will be knowingly shipped or transferred to a person in any jurisdiction where it is unlawful to receive or possess such product(s).
This general policy does not apply to law enforcement agencies and other official end users, licensed dealers, and other parties with the proper licenses upon proof of such authorizations and the presentation of proper identification.
Bear State Tactical shall have no liability to any customer due to the customer’s intentional or unintentional violation of federal, state, or local law(s). Neither Bear State Tactical nor any of its affiliates, licencors, partners, managers, shareholders, directors, officers, employees, or other agents shall have any liability to any user or their principles or agents for any damages, whether general, special, direct, indirect, incidental or consequential, including any lost profits or lost savings, whether or not foreseeable and whether based on contract, tort, common law, or any other theory of liability, statute, or regulations.
As a customer, purchaser, or end user of our products, you expressly acknowledge and agree that Bear State Tactical is providing access to this information in reliance on the disclaimers and limitations set forth herein, and you further acknowledge and agree that such limitations are reasonable. In no event shall Bear State Tactical’s liability to you exceed the actual price you paid for the product obtained from us.
Furthermore, by placing an order with us, you represent that all products purchased will be used in a lawful manner and you are of a legal age, and where applicable, a U.S. citizen or lawful permanent resident of the U.S., to acquire or use such products. No products shall be exported without the proper licenses and or permits.
Bear State Tactical is not responsible:
- For the use, or inability to use, any of the products offered, or the suitability of use for any particular task, or any claims stated in our materials regarding how these products function or work.
- For any damages loss, cost, or damage of any kind arising from the misuse of our products or physical harm caused by our products to anyone or anything. This responsibility is entirely yours, as the buyer.
For any claims that may arise as a result of, whether whole or in part, improper or careless handling in the use of our products, unauthorized modifications, use of improper ammunition (wrong caliber, defective, hand loaded, or reloaded cartridges), abuse, neglect, corrosion, or other influences beyond our immediate and direct control.
- In any manner whatsoever for injury, death, or damage to property as a result of the intentional or accidental discharge of any firearm, or from its proper function when the firearm is used for purposes for which it was not designed.
- For incidental or consequential damages, such as loss of use of property, loss of earnings, or profits, or any other commercial or residential loss.

PAYMENT
You can pay for your order by credit card or debit card. We currently accept payment from all major credit card companies. Payment is taken at the time of your order and authorization must be approved before we can deliver your order. Payment is received in US Dollars only.
SHIPPING & DELIVERY
It is our goal to ship all orders within 10 business days after the order is placed, most, if not all, of your order will be drop shipped from the original OEM. However, due to seasonal demand and/or market fluctuation, shipping times may vary. Items will be delivered via the delivery method chosen at the time of purchase.
Preferred shipping method/carrier is USPS Priority Mail with Delivery Confirmation. Shipping locations includes all 50 states in the US, including Alaska & Hawaii. Other shipping carriers used are: UPS Ground, or FedEx Ground. A shipping provider is selected based on size, content & value of the product being shipped at Bear State Tactical’s discretion.
LOST SHIPMENTS
Bear State Tactical or any OEM partners are not responsible for any lost shipments. If you have purchased insured shipping for your order and your shipment is lost, a lost claim will be submitted to the designated shipper. Please allow up to 30-45 days to process your lost claim with the designated shipper.

Items ordered will be shipped within 1-10 business days of order date and shipped according to the method selected according to our shipping policies.
If for some reason an item is not available, we will contact you directly as soon as possible to make arrangements for future delivery or provide you the option to receive a refund or credit on the item.
We only ship within the US, no International shipping.
It is the customer’s responsibility to ensure that the shipping address provided is correct and a secure location. Bear State Tactical is not responsible for stolen packages after delivery.
If your order contains a lower receiver, there may be an extended period of time needed to process your order as we acquire or update your selected FFL. Your delivery time frame may change depending on how long this process takes. To speed up this process, you may have your FFL submit their paperwork via email to BEARSTATETACTICAL@gmail.com or fax 949-429-1825.
All registered items (legal firearms) will ship separately from all other parts and accessories in your order.
RETURN POLICY
If you are not entirely satisfied with your purchase, we’re here to help. Please read the guidelines below for our return policies and procedures.
GENERAL POLICY
All items must be returned within 30 days and be in new, unused or unaltered condition including all packaging contents. A 25% restocking fee applies to orders being returned to the original payment method. Original shipping charges are non-refundable and returnee is responsible for return shipping. We do not accept returns on used, blemished (purchased as blem), or custom engraved/laser etched items. Attempted returns on non-refundable items will be sent back at the shipper’s expense.
SALES TAX
Sales tax will be added to all California orders.
EXCHANGES & RETURNS
New Product Return Policy
- If you are not satisfied with your purchase, you have up to fifteen (15)days from the date of purchase to return it for a full refund or replacement.
- Unused or unopened product returns must be authorized by Bear State Tactical and have an RMA # (Return Merchandise Authorization Number) before the product is returned. Please contact us first for your RMA #.
- Product and all product packaging and materials must be returned in their original conditionto receive the refund.
- Customers who have returned products for a refund in accordance with our refund and return guideline will be issued a refund when products that are being returned arrive at our facility and are deemed to be sent to us in original condition. Once a refund is issued, please allow 72 hours from issuance for the credit to show on your account.
Orders being exchanged will not be charged a restocking fee. To ensure your exchange is handled properly, please contact us at 949-463-7967 or create a Help Desk Ticket on your My Account page. If you don’t have an account with us, please go to the Contact Us page and fill out the form.
All products sold are new and under warranty from the manufacturer, unless otherwise stated in the product description. If the product is defective, BST will give you a full refund within 10 business days, Not including shipping costs if returned within 30 days of receipt.
Any product, if unused / unopened / defective, may be returned within 30 days from the order date (15% Restocking Fee May Apply). If the part is unused/unopened, you may return it within 15 days for a full refund minus shipping charges.
A 25% restocking fee is charged for any products returned after the 15 day window. Higher restocking fees may apply for registered firearms on a failed background check(s), in upwards of 40%.
Orders cannot be cancelled once processed.
The customer is responsible for return shipping charges unless the return is due to the error of BST order processing.
Sales are final on sale items, clearance merchandise, blemished products & special orders
WARRANTY
If for any reason you have a warranty issue with one of your purchased products, please contact us at 949-463-7967 or create a Help Desk Ticket on your My Account page. If you don’t have an account with us, please go to the Contact Us page and fill out the form.
PLEASE NOTE: We cannot provide warranty work if your items have been altered by you or anyone, from their original state. Contact Us if you have any questions regarding this policy.
Please describe your situation, include your name and order number or transaction id. One of our technical specialists will then review your claim and contact you within 3-5 business days.
If you have images to send, please email them to BEARSTATETACTICAL@gmail.com and include your Help Desk Ticket number in the subject field.
All new products are covered under their respective manufacturer warranty.
Warranty returns will receive product replacement. No cash refunds.
DAMAGED ITEMS
Bear State Tactical is not responsible for any damaged shipments. If you have purchased insured shipping and your order is damaged please contact us immediately. A damage claim will be submitted to the designated shipper. Please allow 30-45 days to process your lost claim with the designated shipper. Shipping damage refunds / exchanges do not include any return shipping, shipping insurance costs or handling / processing fees.
The following information is needed in order to process a claim:
- Pictures of the damaged box/packaging and the damaged products from all sides
- A detailed description of the damage(s)
- The damaged product(s) need to be returned to Battle Arms Development within 7 business days after it is inspected by the carrier’s investigator.
FIREARM PURCHASES
We only ship to valid FFL Dealers. You are required to be 18 years or older for rifles and 21 years or older to purchase pistols or stripped lower receivers. You must send us a copy of your or your transfer dealer’s signed Federal Firearms License before ordering Firearms from this Website. Any applicable local or state licenses required for a firearm purchase must also be sent to BST to be on file.
If the transfer is to the state of California, a valid CA DOJ Centralized List (CL) number of the transfer dealer must also be sent to us.

All orders placed without, or prior to, a signed copy of the Federal Firearms License (or other necessary licensing) on file may be deleted without notice. Bear State Tactical reserves the right to limit the purchase of multiple Firearms.
No AR15/M16/M4 specific parts will be shipped to the state of Connecticut. All such orders will be cancelled.
Stripped Lower Receivers will NOT be shipped to:

FAILED BACKGROUND CHECK
There will be a 40% restocking fee on all lower receivers and complete firearms returned because of failed background checks.
ITAR Export Control Notice & Acknowledgement
Certain products sold by Bear State Tactical are subject to the Arms Export Control Act (AECA), the Export Administration Act (EAA) as continued in effect under the International Emergency Economic Powers Act (IEEPA), the International Traffic In Arms Regulations (ITAR), the Export Administration Regulations (EAR) and the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) Regulations. Bear State Tactical is committed to compliance with these and all applicable U.S. and foreign regulations concerning the import and export of firearms and associated components and technology.
Domestic Customers and Re-sellers should be aware that penalties for violation of U.S. export laws and regulations can reach $1,000,000 per violation and include up to 10 years imprisonment. By purchasing you agree and understand that exporting or purchase with intent to resell for export the products herein is strictly prohibited without a valid export license issued by the U.S. Department of State Office of Defense Trade Controls prescribed in the International Traffic in Arms Regulation (ITAR).
